Not every unpleasant work environment qualifies legally as a hostile work environment. A legally actionable hostile work environment is one in which the harassing treatment of the employee occurs because the person is a member of a protected class and the comments or actions are objectively offensive and are pervasive.
Courts have defined a hostile work environment as:
Manifested by a series of harassing acts that may be described as pinpricks that only slowly add up to a wound; one pinprick may not be actionable in itself, and its abusive nature may not be apparent except in retrospect, until the pain becomes intolerable. Clifton v. Massachusetts Bay Transp. Auth., 445 Mass. 611 (2005). A hostile work environment is one that is “pervaded by harassment or abuse, with the resulting intimidation, humiliation, and stigmatization which poses a formidable barrier to the full participation of an individual in the workplace.” Cuddyer v. Stop & Shop Supermarket Co., 434 Mass. 521 (2001).
